Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the site, you acknowledge that policy.

Newsletter sign-up involves processing described in the Privacy Policy; use that feature only if you agree to that processing.

You consent to receive transactional communications electronically (for example, order confirmations and shipping notices) at the email address you provide. You are responsible for keeping your contact information current.

Marketing email is sent only where permitted by law and your choices (such as newsletter opt-in). You may unsubscribe as described in the Privacy Policy.

You must be at least the age of majority in your place of residence to purchase from Ontiqua. By placing an order, you represent that the information you provide is accurate and that you are authorized to use the payment method submitted.

If we offer account features in the future, you are responsible for safeguarding login credentials and for activity under your account. Notify us promptly if you suspect unauthorized access.

We describe garments, materials, and embroidery as accurately as our photography and product copy allow. Colors and texture may vary slightly by screen, lighting, or production batch — especially for dyed and washed fabrics.

Prices are shown in U.S. dollars unless otherwise stated. Taxes, shipping, and any applicable duties are calculated or disclosed at checkout before you confirm payment.

Prices, promotions, and availability may change without notice until you complete checkout. We reserve the right to limit quantities per customer, refuse service where permitted by law, and cancel or adjust orders affected by obvious pricing, typographical, or inventory errors — with a prompt refund if you were charged in error.

Product images may include styling props or lifestyle settings; only items listed in the order confirmation are included in your purchase.

Placing an order is an offer to purchase. We accept your order when we send an order confirmation email and/or when we begin fulfillment — whichever occurs first. We may decline or cancel an order before acceptance (for example, suspected fraud, stock limitations, or restrictions on shipping destination).

Payment is processed through our secure checkout provider. Card and wallet transactions are subject to the provider’s terms and your issuer’s rules. You authorize us and our payment partners to charge the total shown at checkout, including tax and shipping where applicable.

If payment cannot be completed or is reversed, we may suspend or cancel the order. Repeated failed payment attempts or chargebacks may result in refusal of future orders.

Ontiqua works with vetted production and fulfillment partners to print, embroider, pack, and ship orders. Partner facilities may be located in the United States or other regions; labeling and customs documentation will reflect the origin required for your shipment.

You agree that fulfillment partners may process your name, shipping address, and order details solely to fulfill your purchase, in line with our Privacy Policy.

Delivery windows, regions we serve, and complimentary shipping offers are described on our Shipping page. Risk of loss passes to you when the carrier marks the package as delivered to the address you provided.

Returns, exchanges, and eligibility rules — including our 30-day window for unworn items — are on our Returns page. Those policies are incorporated into these Terms by reference.

Title to products transfers to you when we receive full payment and the item ships, subject to any right of rejection under applicable consumer law.

If you subscribe to email, you consent to receive messages about collections, restocks, and editorial content. You may unsubscribe at any time via the link in each email.

We do not guarantee a fixed sending schedule. Promotional codes, when offered, are subject to stated conditions and may not be combined unless we say otherwise.

You agree not to misuse the site: no unlawful activity, harassment, scraping that overloads our systems, attempts to bypass security, or use of automated tools to harvest data or inventory without permission.

You may not reproduce site content, product photography, or embroidery artwork for commercial resale, counterfeit goods, or misleading affiliation with Ontiqua.

We may suspend or terminate access if we reasonably believe you have violated these Terms or harmed other customers, partners, or the integrity of the site.

Ontiqua names, logos, embroidery designs, photography, video, copy, and site layout are owned by Ontiqua or our licensors and protected by copyright, trademark, and other laws.

You receive a limited, personal, non-transferable license to access the site and to use purchased products for personal wear. No other rights are granted.

If you believe content on the site infringes your rights, contact us with sufficient detail so we can review and respond.

The site and products are provided on an “as is” and “as available” basis to the fullest extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement where allowed.

We do not warrant that the site will be uninterrupted, error-free, or free of harmful components, though we work to maintain a secure, reliable experience.

Nothing in these Terms limits rights you may have under mandatory consumer protection laws in your jurisdiction.

To the fullest extent permitted by law, Ontiqua LLC and its officers, employees, and partners are not liable for indirect, incidental, special, consequential, or punitive damages — including lost profits, data, or goodwill — arising from your use of the site or products.

Our total liability for any claim related to an order or these Terms is limited to the amount you paid us for the affected products in the twelve months before the claim, except where a higher minimum is required by law.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted.

You agree to defend and indemnify Ontiqua LLC against claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the site, violation of these Terms, or infringement of another party’s rights — except to the extent caused by our negligence or willful misconduct.

These Terms are governed by the laws of the United States and the U.S. state in which Ontiqua LLC is organized, without regard to conflict-of-law rules that would apply another state’s laws.

Before filing a formal dispute, please contact us at hello@ontiqua.co so we can try to resolve the matter directly. Many issues — shipping delays, sizing, or order corrections — are faster to settle in conversation.

Where permitted, you and Ontiqua LLC agree that courts located in that state have exclusive jurisdiction over disputes that cannot be resolved informally, except that consumers may bring claims in their home jurisdiction when mandatory consumer law requires.

If you are a consumer in the European Economic Area or United Kingdom, you may also have mandatory rights under local law that these Terms cannot override.

If you are a consumer, statutory warranties and remedies in your jurisdiction may apply in addition to these Terms. Our Returns page describes voluntary return practices that may exceed minimum legal requirements for online sales.

California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834 or by telephone at (800) 952-5210 in connection with unresolved complaints, in addition to contacting us first.

If you believe material on ontiqua.co infringes your copyright, send a notice to hello@ontiqua.co with: identification of the work, the URL of the material, your contact information, a statement of good-faith belief, and a statement under penalty of perjury that you are authorized to act. We may remove or disable access to material that appears infringing and terminate repeat infringers where appropriate.

You may not use the site or purchase products for export or end use prohibited by U.S. export control or economic sanctions laws. By ordering, you represent that you are not located in, under the control of, or a resident of any embargoed or sanctioned jurisdiction and are not on any U.S. government restricted-party list.

We are not responsible for delays or failures caused by events outside our reasonable control — including carrier disruptions, weather, labor disputes, supply shortages, acts of government, or failures of third-party infrastructure — but we will communicate with you when an order is materially affected.

If any provision of these Terms is held invalid, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of that provision.

These Terms, together with the Shipping and Returns pages and our Privacy Policy, constitute the entire agreement between you and Ontiqua LLC regarding the site and purchases, superseding prior understandings on the same subject.

You may not assign your rights under these Terms without our consent. We may assign our rights in connection with a merger, acquisition, or sale of assets.
